Earlier this week, the Spencer City Council unanimously voted to enact a huffing ordinance.
One councilman expressed concern that the individuals caught huffing were not getting the treatment they needed. However the police chief noted that the magistrate can order treatment as deemed necessary and that the ordinance was the initial step in getting the individuals into the system. “As written, the city ordinance allows for the magistrate to determine the most appropriate consequence, while the county ordinance has a $150 fine associated with it.
Spencer’s Youth Director pointed out recent studies show that “7% of Spencer 6th, 8th and 11th graders reported huffing within the previous years” while a councilman countered that “7 percent represented about 50 or 60 students and "that's 50 or 60 kids too many."

Inhalant Related Car Crash in West Virginia Claims a Life

A 29 year-old Fayette County man has been arrested and charged with “driving under the influence causing death” for a July 31st inhalant related crash. The accident claimed the life of a 24 year-old female passenger in the car and injured a pedestrian.
Police determined the driver had been using computer dusting spray behind the wheel and that he was “still high at the time of the crash.” He has been released from jail on a $25,000 bond.

Inhalant Death in Oklahoma, Friends Charged with Manslaughter

On January 1st at 6 am, a 15 year old Ardmore girl died at a home in Wilson. Three 20 year-old individuals who were with her are being charged with manslaughter for allegedly buying an inhalant at a local grocery store and encouraging the girl to abuse the product.
The local district attorney noted "The autopsy came back showing what her cause of death was and it was because of a substance found in inhalants.”

Pennsylvania Man Caught Huffing Second Time After Prison Release

A 28 year-old Carlisle man was arrested after police found him in a mall bathroom “visibly intoxicated on computer duster and unable to stand on his own.” He was arrested on public intoxication.
The article also notes that it is the second time he has been charged with public intoxication by computer duster “since being paroled from an almost year-long stint in Cumberland County Prison on similar charges.” More information on that here. Previously he had been caught huffing computer dusters on August 3rd and before that he served 11-and-a-half months in prison for three huffing related incidents.

A 32 year old woman from Mitchell was arrested for an inhalant abuse related incident that occurred in a Wal-Mart aisle earlier this month. The woman was found semi-conscious in the aisle with a can of computer duster nearby.
Two store employees then saw her put the nozzle to her mouth and inhale from the canister. She tried to flee from the store but collapsed just before reaching the exit.

Two Huffing Related Crashes in North Dakota

Earlier this week two people were arrested in separate alleged huffing related incidents.
A 20 year old woman pleaded guilty to “driving under the influence and driving under suspension, both Class B misdemeanors, and inhalation of vapors, an infraction.” She was sentenced to nine days in jail, a year of unsupervised probation and $500 in fines. Police report that she had been inhaling computer dusting spray while driving when her pickup truck “"drove off the road into a ditch, continued traveling in a grassy field up a steep hill and crashed into a garage.”
Three hours later, a 30 year man was also involved in a huffing computer dusting spray while driving related incident. Officers responded to a report of a man passed out while stopped at an intersection but they located the car nearby in a ditch. It had nearly struck pedestrians, gone over a curb, and landed in a ditch. The driver was still behind the wheel and upon noticing the officers he tried to drive away. The judge suspended his sentence and ordered him to pay $600 in fines.

Update on Fatal Crash from Last Year

In an update to this story from November last year, the driver accused of huffing behind the wheel and causing a crash that killed his passenger was arraigned earlier this week.
On the evening of November 20, 2010 the 20 year old driver was allegedly huffing nitrous oxide from balloons while driving with three passengers in the car. Prosecutors argue at one point he dropped his head and released his hands from the steering wheel “causing him to lose control of his vehicle that went up onto the center median and crashed into a pine tree.”
The crash severely damaged the front of the car and caused the vehicle to catch fire. The 15 year old passenger in the front seat was trapped in the car and died of multiple blunt force trauma injuries. The two passengers in the back seat were able to escape with police assistance and emerged with minor injuries.
The driver was comatose and sustained severe head and thermal injuries and a broken clavicle. Balloons were found in his pants pocket and a “gas cylinder, valve knob for the gas cylinder and a balloon were found on the center median grass near the crash site.”
In March he was charged with “one felony count of vehicular manslaughter with gross negligence while intoxicated with sentencing enhancements and allegations for causing great bodily injury and causing great bodily injury to more than one victim.” Due to his injuries and medical treatment he wasn’t arrested until last Tuesday.

A 35 year old man was arrested after police responded to a report of a man driving “recklessly around a Marshall’s parking lot, running over a grass median and into shrubs.”
They found the driver slumped over the wheel of a pickup truck with the windows open and motor still running. He soon woke up but “his speech was slurred and confused.” He admitted to huffing computer dusting spray and five cans were found in the truck. He was arrested and charged with “inhalation of a toxic chemical for the purpose of intoxication.”

Two undercover officers then entered the store and asked to purchase “nitrous oxide and the paraphernalia used to inhale it.” The owner showed them how to inhale the substance. One officer went back into the store a second time indicating it wasn’t working and the owner “told her she was doing it wrong and he took her in the back and taught her how to do it."
Police recovered $600 worth of nitrous oxide and paraphernalia from the shop and the owner and one employee were charged with “sale of harmful chemicals and possession of drug paraphernalia.”
