Texas Woman Accused of Huffing, Wrecking Car, and Killing Two

Via The Dallas Morning News- Frisco Blog

A 21-year old woman from Texas was charged last week with two counts of manslaughter in the deaths of a 38-year old woman and her 2 year old daughter.   The woman is suspected of huffing compressed air while driving, blacking out, and causing a head-on collision on December 16, 2012.

The woman crossed the 15-foot median and collided with a minivan that held a woman and her two daughters (one daughter survived the accident).   Both vehicles landed on their sides and had extensive damage.

"The woman told investigators at the scene that she had just come the Wal-Mart less than two miles away and blacked out while driving, according to the affidavit that accompanied her arrest warrant." Investigators found that she had purchased industrial strength compressed air from the Wal-Mart.  "According to the affidavit, the compressed air contains a chemical called difluoroethane R-152a that can give a 'quick high' when inhaled. Side effects include nausea, headache, confusion and loss of consciousness, according to the affidavit."

Manslaughter is a second-degree felony. If convicted, the woman could face two to 20 years in prison.

Huffing Behind the Wheel Claims Another Life

Via WSYR TV in New York:

A 20 year old man pleaded guilty to second degree manslaughter in the death of a 19 year old man. The 19 year old was walking home from work when the 20 year old struck and killed him with his car. The driver had purchased computer dusting spray at a Wegman’s and huffed the product in the car before driving off.

The article notes that he “could have spent the holidays with his family before his sentencing next month, but instead he asked the judge to be remanded to the County Justice Center to begin his sentence” and he “didn't think it was fair that he would get to spend Christmas with his family when his victim wasn't able to spend Christmas with [his] family.”

Former UCF Student Sentenced

From The Central Florida Future in Florida

A former University of Central Florida student will spend 18 months in prison in connection to an October 2006 car crash that left another UCF student dead. Malcolm Barnes pled “no contest in a Florida court November 20th for DUI and manslaughter charges.”

Accident reports reveal Barnes was under the influence of inhalants when he drove into oncoming traffic, struck a motorcycle head on, and killed the driver near the UCF campus. Barnes was apparently so high that he was unaware he had hit another vehicle, and dragged the motorcyclist 300 feet before stopping.

Deputies discovered two cans of computer duster and a rag while searching Barnes’ vehicle. Blood tests also confirmed he had been ‘huffing.’

While the minimal prison sentence for a typical DUI manslaughter case is nine years, Barnes was given a lighter sentence due to his “true remorse” for his actions. He extended an apology to family members and friends of the victim stating, “I am ashamed and deeply sorry to be involved so negatively in your lives…you did not deserve this nightmare.”

In addition to serving 18 months in jail, he will also face two years of probation requiring him to spend 150 hours speaking to area youth about the dangers of ‘huffing’ and driving while intoxicated. His driver’s license has been revoked indefinitely.

Party Mom To Face Manslaughter Charges

From FirstCoastNews.com in St. Johns County, Florida

A Florida mom who has been accused of hosting several house parties where teens allegedly drank alcohol, smoked marijuana, and inhaled nitrous oxide appeared in court last week. 51-year-old, Diane Santarelli, “was indicted on two counts of manslaughter and four misdemeanors after two intoxicated teens left a party she was supervising and died in a car accident” last January. The manslaughter charges are second degree felonies, each punishable by up to 15 years in prison.

On January 12, 2009, 18-year-old Jessy Pitts and his 17-year-old passenger Taylor Brennan were killed when Pitts crashed his car into a guardrail while on the way home from a party hosted by Santarelli.

According to court documents Santarelli provided minors with alcohol, marijuana, and nitrous oxide ‘whippets’ over the course of several parties held in her home between September 2008 to January 2009.

Santarelli’s attorney argues that while his client illegally provided drugs and alcohol to minors, she is ultimately not responsible for the deaths of Pitts and Brennan, as both teens willingly got behind the wheel of a car despite being intoxicated. However, the prosecution attests that by directly contributing to the delinquency of a minor, Santarelli is to blame for the fatal crash.

The presiding judge made no motion to dismiss the felony charges last week, despite pleas from Santarelli’s attorney. The case will reconvene in court on December 1st.

Famous Fashion Photographer Killed

From KESQ News in Palm Springs, California

A well-known fashion photographer, Alberto Jose Serejo, 51, was killed during a photo shoot when he was struck by a driver “under the influence of inhalants and prescription drugs” on Highway 62 in San Bernardino County, California late Wednesday.

Serejo, a “Brazilian born Danish photographer was working with live models during a high fashion shoot in front of the Joshua Tree Inn” when a Mazda pick-up truck veered off the highway at 50 mph, jumped the curb, and hit him from behind around 5:10 p.m. An ambulance transported Serejo to nearby High Desert Medical Center where he was pronounced dead at 6:22 p.m.

The driver, who fled the scene, was caught by authorities shortly after 6:00 p.m. when he crashed his truck into an oncoming vehicle at an intersection several miles away. California Highway Patrol officers quickly determined that the vehicle had been involved in the hit-and-run, and took the suspect, 57-year-old Daniel Howell, of Joshua Tree into custody for a drug evaluation and further questioning.

Howell was later arrested on suspicion of driving while under the influence of inhalants and prescription drugs, felony hit and run, and vehicular manslaughter. The California Highway Patrol is investigating the collision.

UPDATE: Driver Taken Into Police Custody

From The Delaware County Daily Times in Pennsylvania

The Pennsylvania driver responsible for killing a 19-year-old girl and seriously injuring her 20-year old friend on August 14, 2009 was arrested by police yesterday on charges of vehicular homicide. Rachael Jankins, 20, initially told investigators that she lost control of her car while “changing a song on her iPod.” Police however, have confirmed that Jankins was under the influence of marijuana and using inhalants at the time of the accident.

Yesterday afternoon Jankins was taken into custody without incident at her residence and was “transported to the Upper Darby police station for questioning.” Police arrived in a “caravan of four vehicles unannounced at 1:30 p.m. at Jankins' home with a warrant for her arrest.”

Jankins appeared in court before a District Judge yesterday and was “arraigned on charges of vehicular homicide, homicide by vehicle while driving under the influence, reckless driving, involuntary manslaughter, DUI, simple and aggravated assault, reckless endangerment, and illegal use of solvents for allegedly huffing prior to the accident.” Her bail has been set at 10 percent of $250,000. A preliminary hearing is scheduled for Wednesday, but it is not yet known if Jankins has an attorney.
